Terms of Services
Last Updated: September 25, 2026
A Clean Home. A Better Life.
IMPORTANT: THESE TERMS AFFECT YOUR LEGAL RIGHTS. PLEASE READ THEM CAREFULLY BEFORE BOOKING OR RECEIVING SERVICES FROM IN HOUSE CLEANERS, LLC. THESE TERMS INCLUDE PROVISIONS REGARDING PAYMENT, RECURRING SERVICES, CANCELLATIONS, LIMITATIONS OF LIABILITY, BINDING ARBITRATION, AND A CLASS-ACTION WAIVER.
Section 1 – Introduction & Acceptance of Terms
Welcome to In House Cleaners, LLC, a Texas limited liability company based in Wichita Falls, Texas (“In House Cleaners,” “Company,” “we,” “us,” or “our”).
In House Cleaners provides professional residential cleaning, Airbnb and short-term rental cleaning, commercial cleaning, deep cleaning, recurring cleaning, move-in and move-out cleaning, and other related cleaning services (collectively, the “Services”).
These Terms of Service (“Terms”) establish the agreement between In House Cleaners and the individual or entity purchasing or receiving Services (“Client,” “you,” or “your”).
By scheduling Services, accepting a quote, submitting payment information, paying a deposit, electronically accepting these Terms, or allowing us to perform Services, you acknowledge and agree to be bound by these Terms.
Nothing in these Terms waives any consumer right or remedy that cannot legally be waived under Texas or federal law.
Section 2 – Quotes, Estimates & Property Information
Please contact In House Cleaners to receive a quote for your requested Services.
Quotes are based upon information provided by the Client, which may include property size, number of bedrooms and bathrooms, type of Service, frequency of Service, present condition of the property, special requests, photographs, accessibility, and other relevant circumstances.
Our quotes are based upon the scope and condition represented to us at the time of booking.
We strive to provide accurate pricing; however, a property may require materially more time or labor than reasonably anticipated based upon the information originally provided.
If our team encounters conditions that materially change the scope or anticipated labor, we will notify you before performing additional work that would result in additional charges.
We will not perform additional billable Services outside the agreed scope without your authorization.
Unless otherwise stated in writing, quotes expire thirty (30) days after issuance.
Section 3 – Performance of Services
In House Cleaners agrees to perform the Services identified in your accepted quote, booking confirmation, service agreement, or invoice.
If a requested Service is not included in your booking, you are responsible for confirming that the additional Service has been added before work begins.
When you hire In House Cleaners, you are contracting with In House Cleaners, LLC, not with any particular individual cleaner.
Services may be performed by employees, independent contractors, agents, team members, or other service providers engaged by In House Cleaners as permitted by applicable law.
We reserve the right to assign or change the person or team providing your Services. Requests for a particular cleaner will be considered but cannot be guaranteed.
Arrival and completion times are estimates. Traffic, weather, previous appointments, staffing issues, property conditions, emergencies, and other circumstances may result in delays or rescheduling. We will make reasonable efforts to communicate material delays.
Property Access
You agree to provide safe and timely access to the property.
Clients are responsible for providing accurate entry instructions, keys, door codes, gate codes, alarm instructions, or other information required to enter the property.
If our team cannot access the property because of circumstances within the Client’s control, the appointment may be subject to the cancellation provisions in Section 8.
We recommend — but do not require — that you are home before and after our Services are finished so that you can review the job we performed and advise us if any changes are needed. If you are not home at the conclusion of our Services, our
Services will be deemed completed and accepted by you upon us exiting your home
Other Workers Present
In House Cleaners cannot guarantee the same cleaning results when movers, contractors, painters, repair technicians, handymen, construction workers, or other unaffiliated workers are simultaneously performing work in the property.
We are not responsible for areas that become dirty, damaged, disturbed, or altered by third parties during or after our Services.
Section 4 – Scope Exclusions
Unless specifically included in your written quote, booking confirmation, or agreed add-on Services, the following are not included in a standard cleaning:
Wall Washing. None of our cleaning packages include washing walls. Wall washing may be added as an optional service at a rate of $68.00 per hour, per cleaner.
Tile Grout & Caulking. We do not perform deep restoration cleaning of tile grout or caulking as part of standard cleaning Services. Proper restoration of heavily stained grout may require specialized equipment or a specialty service. Old, deteriorated, discolored, or mold-affected caulking around tubs, showers, sinks, or other areas may require removal and re-caulking, which is outside the scope of our cleaning Services. We may attempt reasonable surface cleaning of affected areas, but In House Cleaners does not guarantee removal of stains, discoloration, mildew, mold staining, or deterioration from grout or caulking.
Interior of Dishwashers. Unless specifically quoted as an add-on, we clean the exterior of dishwashers but do not clean the internal mechanical portions of dishwashers.
Exterior Cleaning. Unless expressly agreed in writing, Services do not include exterior windows, building exteriors, roofs, driveways, hardscape, pressure washing, gutters, or exterior grounds.
Specialty Restoration. We do not provide mold remediation, fire or smoke restoration, water remediation, crime-scene cleaning, hazardous-material remediation, or other regulated specialty restoration Services.
Heavy Objects. Our team is not required to move furniture, appliances, or other objects that cannot safely be moved by one person without risk of injury or property damage.
Section 5 – Flat-Fee, Hourly & Recurring Cleaning Services
Flat-Fee Services
Certain Services may be offered for a flat fee based upon the represented property size, condition, requested scope, estimated labor, and other factors.
A flat fee is based upon the condition represented at booking and remains subject to Section 14 concerning materially different or unexpected property conditions.
Hourly Services
In House Cleaners may offer Services based upon time purchased.
All Hourly Services will be provided to you on an ‘as-needed’ basis and at your direction. Our Hourly Services will be provided at the hourly rate specified in your quote. All time is billed to you in fifteen (15) minute increments.
Important Notice Regarding Hourly Services: If you have selected an hourly cleaning, our team will clean as much as possible within the time purchased. We cannot guarantee that every requested task will be completed within the allotted time. If additional time is needed and desired, it may be added at a rate of $68.00 per hour, per cleaner, provided the request is made before our team departs. Once our team has left the property, no additional time may be added to that appointment.
Recurring Cleaning Services
In House Cleaners offers weekly or monthly recurring cleaning services (“Recurring Cleaning Service”).
Recurring Cleaning Service inclusions and costs vary depending upon your property, selected Service, frequency, customization, add-ons, and other circumstances disclosed at enrollment.
Each Recurring Cleaning Service plan is recurring and will automatically continue without further action by you until cancelled.
Before you enroll, In House Cleaners will clearly disclose the applicable Service frequency, price or method of determining the price, recurring nature of the arrangement, and cancellation procedure.
By enrolling in Recurring Cleaning Service and providing a payment method, you expressly authorize In House Cleaners and/or its payment processor to charge the payment method provided for each scheduled Recurring Cleaning Service, including applicable taxes, authorized add-ons, and disclosed fees.Your authorization remains in effect until you cancel your Recurring Cleaning Service.
You may cancel Recurring Cleaning Service at any time by emailing: info@inhousecleaners.com
Cancellation of Recurring Cleaning Service stops future recurring appointments and future recurring charges after the effective date of cancellation. A cancellation submitted for an appointment already within the twenty-four (24) hour cancellation window remains subject to Section 8.
If you enrolled electronically and an additional electronic cancellation method is made available through our booking platform, you may also use that method.
If In House Cleaners materially changes the recurring Service price, we will provide reasonable advance written notice before the new price is charged. Our goal is to provide at least thirty (30) days’ notice of recurring price changes whenever reasonably practicable.
Recurring Services are also subject to the Cancellation provisions below.
Section 6 – Deposits & Reservation of Services
In House Cleaners may require a deposit to reserve a requested appointment, date, or Service window.
The amount of any required deposit will be disclosed before payment.
An appointment requiring a deposit is not considered reserved until the required deposit has been received.
Unless otherwise stated, a deposit will be applied toward the total amount due for the scheduled Service.
Except as provided under Section 8 or required by applicable law, deposits are non-refundable.
No interest accrues on deposits.
Section 7 – Payment, Billing & Texas Sales Tax
All prices are stated in United States Dollars.
We accept the payment methods made available through our booking or payment system.
By providing payment information, you represent and warrant that:
- the information provided is accurate;
- you are authorized to use the payment method; and
- you authorize In House Cleaners and/or its payment processor to charge amounts legitimately owed under your booking or Recurring Cleaning Service.
Applicable Texas state and local sales and use taxes will be added to taxable Services as required by law.
Payment is due according to your booking confirmation, invoice, or payment authorization.
If a payment is declined or reversed, you remain responsible for valid amounts owed for Services provided.
In House Cleaners may suspend or cancel future Services while an account remains unpaid.
Past-due accounts may be referred to a collection agency or attorney where permitted by law, and Clients may be responsible for reasonable collection expenses and attorney’s fees to the extent recoverable under applicable law.
Billing Disputes & Chargebacks
If you believe a charge is incorrect, please contact us promptly at info@inhousecleaners.com so we have an opportunity to investigate and resolve the issue.
Nothing in these Terms waives any lawful chargeback or billing-dispute right.
In House Cleaners reserves the right to contest fraudulent, inaccurate, or improper chargebacks and may provide relevant quotes, confirmations, communications, photographs, payment authorizations, invoices, and other records to the applicable payment processor or financial institution.
Section 8 – Cancellations, Rescheduling & Refunds
Cancellations. All cancellations or changes to the date of our Services must be made no later than twenty-four (24) hours prior to the scheduled start time.
- Cancellation while our team is en route: A trip fee of $68.00 will be charged.
- Any remaining balance paid for Services not performed will be refunded.
- Cancellation after our team has arrived on-site: No refund will be issued for the scheduled appointment, except where otherwise required by applicable law.
- Cancellation within twenty-four (24) hours of the scheduled start time, but before our team is en route: In House Cleaners is entitled to retain any Deposit paid. The retained Deposit will be applied as a credit toward your next booking with In House Cleaners. No cash refund of that Deposit will be issued, except where otherwise required by law.
Recurring Cleaning Service may be cancelled at any time by emailing: info@inhousecleaners.com
Cancellation of the recurring plan does not eliminate cancellation charges or deposit consequences applicable to an appointment already inside the twenty-four (24) hour cancellation window.
Statutory Cancellation Rights
Nothing in these Terms restricts a cancellation or refund right provided by applicable federal or Texas law.
If a transaction qualifies for a statutory cancellation period, including a qualifying consumer transaction under Texas Business & Commerce Code Chapter 601, the applicable statutory cancellation right controls over any inconsistent provision of these Terms.
Section 9 – Our 48-Hour Satisfaction Guarantee
At In House Cleaners, we are committed to professional workmanship and world-class service.
If an area included within the purchased scope of Services was not cleaned to your reasonable satisfaction, you must notify us in writing at info@inhousecleaners.com within forty-eight (48) hours after completion of the Service.
Please provide enough information to allow us to identify the concern and, when reasonably possible, photographs showing the affected area.
If the concern falls within the purchased scope, In House Cleaners will make reasonable efforts to arrange a corrective cleaning as promptly as practicable and, where scheduling and property access permit, within approximately forty-eight (48) hours after receiving your notice.
Our Satisfaction Guarantee is intended to give us an opportunity to correct cleaning-related concerns. The remedy under this Guarantee is re-cleaning of the affected area rather than a cash refund, unless In House Cleaners expressly agrees otherwise or a refund is required by law.
The Satisfaction Guarantee does not apply when:
- the concern is reported more than forty-eight (48) hours after Service;
- the complained-of work was outside the purchased scope;
- another person or contractor altered or dirtied the area after we completed Services;
- access to the property is no longer available;
- permanent staining, deterioration, damage, mineral deposits, discoloration, mold staining, or another condition cannot reasonably be corrected through ordinary cleaning; or
- the Client refuses to provide In House Cleaners a reasonable opportunity to inspect and correct the concern.
Section 10 – Workplace & Cleaner Safety
The safety of our cleaning professionals is extremely important.
In House Cleaners may refuse, discontinue, or modify Services where conditions reasonably create a risk of injury, illness, contamination, or property damage.
Our cleaning professionals are not required to perform:
- work beyond what can safely be reached using Company-approved ladders or step stools;
- work requiring a cleaner to stand on countertops, toilets, tubs, furniture, appliances, or other unsafe surfaces;
- biohazard or bodily-fluid cleanup;
- active mold remediation;
- cleaning in areas with significant insect, bedbug, roach, flea, rodent, or similar infestation;
- handling of needles, illegal drugs, hazardous chemicals, weapons, or dangerous substances;
- tasks involving structurally unsafe conditions; or
- any other task that reasonably jeopardizes the health or safety of our team.
Undisclosed Pest Infestations
Clients must disclose known significant pest or insect infestations before Service.
If our team discovers an undisclosed infestation, including bedbugs, fleas, roaches, termites, or similar conditions, In House Cleaners may stop or refuse Service immediately because of health, safety, and cross-contamination risks.
Any refund or credit will be determined according to the circumstances, work already performed, costs incurred, and applicable law.
Section 11 – Pets, Valuables, Fixtures & Client Responsibilities
Pets Clients are responsible for appropriately securing or supervising pets when necessary.
Please advise us in advance of animals that are aggressive, anxious, prone to escape, or otherwise may affect team safety.
In House Cleaners is not responsible for injury involving an improperly secured animal or for an animal escaping except to the extent caused by our negligence or other liability that cannot legally be limited.
Personal Property & Valuables Before Service, Clients should securely store cash, jewelry, wallets, medications, firearms, sensitive documents, collectibles, sentimental items, and other valuables.
Irreplaceable, antique, specialty, fragile, or unusually valuable objects should be removed from the work area or specifically identified before Service.
Specialty Surfaces Clients must advise us of surfaces requiring specialty care, including specialty stone, finishes, coatings, antique furniture, custom cabinetry, delicate flooring, or manufacturer’s cleaning restrictions.
In House Cleaners cannot reasonably be expected to know about undisclosed specialty treatments or finishes.
Fixtures & Pre-Existing Conditions The Client is responsible for identifying loose, damaged, improperly installed, unstable, cracked, deteriorated, or otherwise compromised fixtures and furnishings.
In House Cleaners is not responsible for deterioration or breakage caused solely by pre-existing damage, ordinary wear and tear, defective materials, or improper installation.
Utilities The property must have working electricity, running water, adequate lighting, and a reasonably safe working temperature where such utilities are necessary to perform Services.
Section 12 – Damage Claims
If you believe our team damaged property while performing Services, please contact info@inhousecleaners.com as soon as reasonably possible and preferably within forty-eight (48) hours after discovering the alleged damage.
You should provide photographs, available receipts, and other information reasonably necessary for us to investigate.
Except in an emergency or when necessary to prevent additional damage, please do not repair, discard, or dispose of the item before giving In House Cleaners a reasonable opportunity to inspect it.
Responsibility for damage remains subject to applicable law and Section 22 of these Terms.
Section 13 – Move-In & Move-Out Cleaning
Move-in and move-out cleaning is based upon the purchased scope of Services.
Clients are responsible for confirming requirements imposed by landlords, property managers, purchasers, sellers, real estate professionals, or lease agreements.
Security Deposits. In House Cleaners does not guarantee return of any security deposit and makes no representation that a cleaning will satisfy the subjective requirements of a landlord, property manager, purchaser, or other third party.
If your landlord or property manager has a cleaning checklist, we encourage you to provide it before booking so we can determine whether the requested tasks fall within our scope.
Access Following Service
Continued access to the property is required for us to honor our Satisfaction Guarantee.
If keys or possessions are transferred to a landlord, buyer, property manager, or other third party and In House Cleaners can no longer access the property, our ability to provide corrective Services may end.
For move-in cleaning, if movers enter the property or belongings are placed in the home before concerns are reported, any available corrective work may need to occur around those items.
Section 14 – Unexpected or Materially Different Property Conditions
Our pricing is based upon the condition described when the Service is booked.
Materially different conditions may include, without limitation:
- unusually heavy grease buildup;
- extreme pet hair;
- excessive trash or clutter;
- significant soap scum or mineral deposits;
- heavy nicotine or smoke residue;
- post-construction dust or debris not disclosed in advance;
- excessive food buildup;
- excessive grime on kitchen cabinetry, stovetops, vent hoods, bathrooms, or flooring; or
- conditions requiring substantially more labor than reasonably expected.
If our team encounters materially different conditions, we will contact you.
You may generally choose either to:
- authorize additional labor or Services at the price disclosed to you; or
- have the team complete as much as reasonably possible within the original purchased scope.
We will not knowingly exceed the authorized scope without your approval.
Section 15 – Airbnb & Short-Term Rental Cleaning
Airbnb and short-term rental turnover Services are provided according to the Services specifically purchased.
Laundry, linen changes, bed preparation, supply restocking, inventory checks, damage reporting, refrigerator cleanout, guest-item handling, and other hosting-related tasks are included only when agreed upon.
In House Cleaners is not responsible for delays or incomplete turnover caused by:
- late guest departures;
- early guest arrivals;
- unavailable access;
- absent or insufficient linens;
- missing owner-supplied products;
- power or water outages;
- excessive undisclosed conditions;
- owner, guest, or third-party interference; or
- circumstances beyond our reasonable control.
Section 16 – No Direct Solicitation or Hiring of Our Cleaning Professionals
In House Cleaners invests substantial time and resources in recruiting, screening, onboarding, training, scheduling, and managing our cleaning professionals.
During your relationship with In House Cleaners and for twelve (12) months following your most recent Service, you agree not to knowingly circumvent In House Cleaners by directly hiring or engaging a cleaner introduced to you through In House Cleaners to provide substantially similar cleaning Services outside of In House Cleaners without our prior written permission.
If a Client directly hires or contracts with such a worker in violation of this Section, In House Cleaners may seek a reasonable placement or recruitment fee of up to $1,000 per worker, together with other remedies available under applicable law.
This provision is intended to protect legitimate recruiting and workforce investments and shall be enforced only to the extent permitted by applicable law.
Section 17 – Photographs & Service Documentation
In House Cleaners may take photographs before, during, and after Services for quality-control, documentation, training, claim investigation, and customer-service purposes.
Unless you opt out in writing before Service, you authorize In House Cleaners to use non-identifying before-and-after photographs of cleaned areas for reasonable advertising, website, portfolio, and social-media purposes.
We will make reasonable efforts to exclude:
- addresses;
- identifying mail or documents;
- family photographs;
- financial or medical information;
- identifiable occupants; and
- other obviously private information.
Photographs prominently featuring an identifiable Client or other person will not be used for advertising without appropriate permission.
No royalty or compensation is owed for authorized use of non-identifying service photographs.
To opt out of marketing photographs, email info@inhousecleaners.com before your appointment.
Section 18 – Customer Reviews & Feedback
In House Cleaners welcomes honest feedback from our customers.
If you are happy with our Services, we highly encourage you to leave a review on an online platform of your choosing. Reviews are how potential clients see our past work and are part of how we continue to grow our business.
Nothing in these Terms prohibits or penalizes a Client for making an honest review, assessment, or statement regarding our Services.
If something did not meet your expectations, we sincerely encourage you to contact us promptly at info@inhousecleaners.com so that we have an opportunity to understand your concern and, where appropriate, exercise our Satisfaction Guarantee.
Nothing in this Section prevents In House Cleaners from responding to or pursuing lawful remedies concerning content that is knowingly false, fraudulent, defamatory, threatening, harassing, or otherwise unlawful.
Section 19 – Intellectual Property
The In House Cleaners name, logos, designs, slogans, graphics, original photographs, website content, written materials, and other proprietary branding may be protected by trademark, copyright, and other intellectual-property laws.
Except where permitted by law, no person may reproduce, distribute, sell, license, or commercially use In House Cleaners’ intellectual property without prior written permission.
Section 20 – Service Disclaimer
In House Cleaners strives to provide dependable, professional, high-quality cleaning Services.
However, cleaning results depend upon numerous factors including the age, condition, material, prior maintenance, wear, staining, buildup, damage, and construction of the property being cleaned.
We do not guarantee that every stain, discoloration, odor, mineral deposit, mold stain, scratch, permanent mark, deterioration, or other condition can be removed through cleaning.
Cleaning is not restoration.
Except for promises expressly made in these Terms and warranties that cannot legally be disclaimed, Services are provided subject to the limitations stated herein.
Section 21 – Force Majeure & Events Beyond Our Control
In House Cleaners is not responsible for delay, rescheduling, or inability to perform caused by events reasonably beyond our control, including severe weather, natural disasters, road closures, power or water outages, governmental orders, emergencies, sudden illness, staffing emergencies, property access issues, or similar events.
When reasonably possible, we will communicate with you and attempt to reschedule affected Services.
Section 22 – Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN HOUSE CLEANERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE SERVICES, INCLUDING LOST PROFITS OR LOSS OF USE. TO THE FULLEST EXTENT PERMITTED BY LAW, IN HOUSE CLEANERS’
AGGREGATE LIABILITY ARISING FROM A PARTICULAR SERVICE SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID TO IN HOUSE CLEANERS FOR THE SERVICE GIVING RISE TO THE CLAIM.
Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded, including liability arising from fraud, willful misconduct, gross negligence where applicable, or rights and remedies that cannot lawfully be waived under the Texas Deceptive Trade Practices–Consumer Protection Act or other applicable law.
Section 23 – Governing Law, Dispute Resolution & Binding Arbitration
These Terms are governed by the laws of the State of Texas and applicable federal law.
Before initiating formal proceedings, the Client and In House Cleaners agree to make a reasonable good-faith effort to resolve the dispute directly.
EXCEPT FOR AN INDIVIDUAL CLAIM ELIGIBLE FOR SMALL CLAIMS COURT, A CLAIM FOR EMERGENCY INJUNCTIVE RELIEF, OR ANOTHER CLAIM THAT APPLICABLE LAW PROHIBITS FROM BEING ARBITRATED, ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN A JURY TRIAL.
Unless otherwise mutually agreed, arbitration shall be administered by JAMS pursuant to the applicable JAMS consumer arbitration rules then in effect.
The arbitration shall take place in Wichita County, Texas, or remotely if permitted by the applicable rules and agreed by the parties.
The arbitrator may award any remedy available to the individual party under applicable law.
Arbitration fees shall be allocated in accordance with applicable JAMS consumer standards and governing law.
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement where applicable.
A prevailing party may recover attorney’s fees or costs only where authorized by applicable law, contract, or applicable arbitration rules.
Section 24 – Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND IN HOUSE CLEANERS AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS.
NEITHER PARTY WILL SEEK TO HAVE A DISPUTE HEARD AS A CLASS ACTION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, CONSOLIDATED ACTION, OR CLASS ARBITRATION.
If this provision is determined unenforceable with respect to a particular claim, applicable law will govern that claim.
Section 25 – General Provisions
Entire Agreement. These Terms, together with your accepted quote, booking confirmation, invoice, recurring Service authorization, and any written Service-specific agreement constitute the agreement relating to your Services.
Specific Booking Terms. If a written booking confirmation expressly conflicts with these Terms regarding the particular Service, price, date, or included scope, the specific booking term controls for that issue.
No Waiver. Failure by In House Cleaners to enforce a provision on one occasion does not waive the right to enforce it later.
Assignment. The Client may not assign rights or obligations under these Terms without prior written consent from In House Cleaners.
Relationship. Nothing in these Terms creates a partnership, joint venture, franchise, employment relationship, or agency relationship between the Client and In House Cleaners.
Severability. If any provision is determined to be invalid or unenforceable, the remainder of these Terms shall continue in effect to the fullest extent permitted by law.
Electronic Communications. You consent to receive booking confirmations, invoices, reminders, service notices, receipts, and other transaction-related communications electronically using the contact information you provide, subject to applicable law.
Updates. In House Cleaners may update these Terms prospectively. Unless otherwise required by law, the version in effect when a Service is booked will govern that Service.
Non-Waiver of Consumer Rights. Nothing in these Terms is intended to waive any right or remedy that cannot lawfully be waived under Texas or federal consumer-protection law.
